Legal socialization and compliance behavior towards child support after divorce among Muslim fathers in Selangor, Malaysia.

Abstract
Though the issue of neglecting child supports among Muslim fathers have
been reported as one of the causes of divorce, and become worst postdivorce,
there are still many fathers out there who are willing to comply with
the Shariah Court orders on child supports. Throughout literature, it is
accepted that legal socialization is related to one’s ability to comply with the
law. From criminal law perspectives, the development of legal socialization
involved social and cognitive factors. However, the extent of these two factors
within the context of Islamic Family Law is uncertain. Hence, using a
phenomenological approach, this study attempts to explore the extent of social
and cognitive factors in the development of legal socialization within the
context of Islamic Family Law, specifically on compliance to a child support
order. By collecting the views of those who have experienced divorce process,
semi-structured interviews were carried out among a total of four Muslim
fathers. Thematic analysis by using an Nvivo software, have identified four major themes which are ‘contribution of socialization process’, ‘positive
thoughts’, Informant’s experiences with legal system’ and ‘self-attitude’. Each
of the themes was discussed accordingly together with the conclusion and
implications of the study.
